DA SCARTO A “VALORE”: RIFIUTI E SOTTOPRODOTTI
NELLA BIOECONOMIA CIRCOLARE DELLA FILIERA
AGROALIMENTARE

ABSTRACT:
Il saggio indaga la trasformazione del binomio rifiuti/sottoprodotti nella filiera agroalimentare alla luce del paradigma della bioeconomia circolare. In tale cornice, il contributo mette in luce le ambiguità applicative generate dalle categorie giuridiche di rifiuto, sottoprodotto e materia prima secondaria, evidenziando come la centralità del criterio soggettivo del “disfarsi” e l’onerosità probatoria dell’“ulteriore utilizzo certo” producano un’elevata incertezza operativa, specie nelle attività primarie. Particolare rilievo assumono i casi relativi a residui vegetali, sottoprodotti vitivinicoli, sansa umida, sfalci e potature, reflui agricoli e zootecnici, nonché la disciplina dei sottoprodotti di origine animale. Il saggio mostra come si renda necessaria una profonda ri-progettazione delle categorie e degli strumenti normativi, economici e di governance, affinché la circolarità diventi regola, la qualificazione come rifiuto eccezione e l’impresa agricola possa essere riconosciuta non solo come potenziale fonte di impatto, ma come protagonista reale della transizione ecologica.

The article examines the transformation of the waste/by-product dichotomy within the agri-food supply chain in the light of the circular bioeconomy paradigm. Within this framework, it highlights the practical ambiguities produced by the legal categories of waste, by-product and secondary raw material, showing how the centrality of the subjective criterion of “discarding” and the evidential burden of proving “further certain use” give rise to significant operational uncertainty, especially in primary production activities. Particular attention is devoted to the cases concerning plant residues, winemaking by-products, olive pomace, pruning and mowing residues, agricultural and livestock effluents, as well as the regulation of animal by-products. The article argues that a thorough redesign of legal categories and of regulatory, economic and governance tools is required, so that circularity becomes the rule, waste qualification the exception, and the agricultural enterprise can be recognised not only as a potential source of environmental impact, but as a genuine protagonist of the ecological transition.
