LA PRASSI ITALIANA IN TEMA DI TUTELA PER EVOCAZIONE DELLE INDICAZIONI GEOGRAFICHE DEI VINI

ABSTRACT:
L’Italia è il paese europeo con il numero più elevato di Indicazioni Geografiche nel settore dei vini. Nel presente contributo sono analizzate alcune decisioni in materia di evocazione di DOP e IGP a livello giudiziario e amministrativo, allo scopo di capire se la giurisprudenza italiana è in linea con quella europea o se a tale riguardo esiste una “via italiana”. Ciò che emerge da questa analisi è un quadro complesso e talvolta non unitario e non sempre conforme agli insegnamenti della Corte di Giustizia europea in materia di evocazione. Uno dei temi più delicati sembra essere il rapporto fra l’evocazione e il fattore dell’affinità o comparabilità fra i prodotti.

Italy is the European country with the highest number of Geographical Indications in the wine sector. This article analyses some decisions on the evocation of PDOs and PGIs at judicial and administrative level, with a view to understanding whether Italian case law is in line with European case law or whether there is an “Italian way” in this regard. What emerges from this analysis is a complex and sometimes inconsistent picture that does not always comply with the teachings of the European Court of Justice on evocation. One of the most sensitive issues seems to be the relationship between evocation and the factor of similarity or comparability between products.
